Reporting Defect Apparatus: (Section 81 / 140)

What is a Section 81 / 140 Defect? - This refers to the section of the ‘New Roads and Street Works Act (NRSWA) 1991.

Under these sections of the act, all Statutory Undertakes and other service industries have an obligation to ensure their street apparatus is maintained to the reasonable satisfaction of the Streets / Roads Authority (local).

If the Street/Local Authority identifies an item of defective apparatus they deem requires attention, they will report the occurrence to the company owning the affected apparatus as a Defective.

Who should they contact? - For Openreach owned equipment, the authorities must contact:

Provide an accurate location and encouraged to provide either a 12 digit Grid reference or full Post Code .

The DBYD team will issue a unique reference number and arrange for an engineer to attend site.
